TRESPASS POLICY

Purpose

The purpose of this policy is to designate college appointed authority to campus police officers in matters of college trespassing. In addition, establishing procedures for Pellissippi State Campus Police to issue and enforce no-trespass warnings issued to a person who is, has been or is threatening to be present on Pellissippi State property and who has engaged, or is reasonably likely to engage, in criminal activity, a violation of Pellissippi policy, or conduct that is or may reasonably be deemed to be threatening, disruptive, or violent.

Policy Statement

All persons on campus are subject to all rules and regulations of Pellissippi State Community College, the Tennessee Board of Regents (TBR), and to all applicable federal and state laws and regulations. In addition, all persons who operate motor vehicles on campus agree by such operation to be subject to college and TBR rules, regulations, policies and procedures on traffic and parking. It is the policy of Pellissippi State Community College that campus police officers have the authority to request and ultimately enforce trespassing incidents. Campus police officers are college appointed authorities and therefore are authorized by the college president to issue no-trespass warnings to a person who has been or is threatening to be present on PSCC property who has engaged or is reasonably likely to engage in criminal activity, or conduct that may be deemed by campus police to be threatening and/or disruptive to college operations or violent.

Procedures

  1. All persons on campus must provide adequate identification upon request to Campus Police or security personnel of the College. Personnel and students of the College who refuse to provide such identification may be subject to disciplinary action from the college; other persons who are not affiliated with the college may be requested to leave the campus, by campus police officers based on concerns for campus safety, if the person(s) refuses, they may be subject to lawful removal and prosecution under T.C.A. 39-14-405. As appointed authorities of the college campus police officers may request persons leave campus and/or issue Criminal Trespass Warnings based on the parameters of this policy statement and the violations or suspected violations Tennessee Code Annotated.
  2. Campus police officers may issue a Criminal Trespass Warning to individuals who have been or are threatening to be present on PSCC property who have engaged or are reasonably likely to engage in criminal activity, or conduct that may be deemed by campus police to be threatening and/or disruptive to college operations or violent.
  3. Campus police officers issuing a Criminal Trespass Warning will document their actions on a police incident report and provide a copy of the Criminal Trespass Warning to the trespassed individual and include the original with their police incident report. Notification of the issuance will be provided to the college president, the Behavioral Intervention Team, Human Resources and the Dean of Students.
  4. Persons who are found in violation of a Criminal Trespass Warning may be arrested by campus police officers.
